Welcome to Buy Vibes! The terms “we,” “us,” and “our” refer to Buy Vibes. This website, store, and related services (collectively, the “Services”) are powered by Shopify. These Terms of Service (“Terms”) govern your use of the Services, your transactions with us, and your legal rights and obligations. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy and Return & Refund Policy (each as posted on our site). If you do not agree, please do not use the Services.

1. Eligibility & Account

  • You represent that you are at least 18 years old (or the age of majority in your jurisdiction) or using the Services under supervision of a legally authorized guardian.

  • You agree that any account you create is for your personal (non-commercial) use, unless explicitly authorized otherwise.

  • You must provide accurate, current, and complete information. You are responsible for maintaining the security of your account credentials (username, password, etc.) and all activity under your account.

  • You may not transfer, sell, or assign your account or any rights under these Terms without our prior written consent.

2. Products & Descriptions

  • We strive to present accurate descriptions and images of our products. However, due to varying device displays, colors or appearance may differ in person.

  • We do not guarantee that a product will meet your expectations solely based on what is shown online.

  • All product descriptions, availability, and pricing are subject to change at any time without notice, at our sole discretion.

  • We reserve the right to discontinue any product or limit quantities sold to customers, regions, or jurisdictions.

3. Orders & Acceptance

  • Placing an order is your offer to purchase. We reserve the right to accept or decline any order at our sole discretion.

  • Your order is not confirmed until we send you an order confirmation or shipping notification.

  • We must successfully receive and authorize your payment before accepting your order.

  • Once we accept your order, we may still cancel it (for example, due to stock issues, pricing errors, or legal constraints). If we do so, we will notify you and refund any amount paid.

  • Please review your order carefully before placing it, since cancellation after acceptance may not always be possible.

  • All purchases are subject to our Return & Refund Policy.

4. Pricing, Taxes & Payment

  • The price at checkout is the price you pay, which includes product cost and may include shipping, handling, and applicable taxes (depending on your location). Unless stated otherwise, prices exclude taxes and shipping.

  • We reserve the right to change prices, promotions, or offers at any time, subject to constraints under applicable law.

  • You are responsible for providing valid payment details. By placing an order, you warrant that you are authorized to use the payment method provided.

  • If your payment is declined, we may cancel your order.

  • For Cash on Delivery (COD) orders, additional COD charges (if applicable) may apply and will be displayed at checkout.

5. Shipping & Delivery

  • We aim to dispatch your order within the timeline indicated at checkout, but these are estimates only and not guaranteed.

  • Once we transfer the package to the courier, the title and risk of loss for the product pass to you.

  • We are not responsible for delays caused by customs, carrier issues, force majeure, or events outside our control.

  • If you fail to receive the package due to incorrect address or failure to collect, you may be responsible for reshipment costs.

6. Returns, Exchanges & Refunds

  • Our returns, exchanges and refund practices are governed by our Return & Refund Policy, which is incorporated herein by reference.

  • You agree to follow the procedure prescribed in that policy to return or exchange products.

7. Intellectual Property

  • All content on the Services (text, images, logos, graphics, designs, software) is owned by or licensed to Buy Vibes, its affiliates, or licensors and protected under Indian and international intellectual property laws.

  • You may use the Services for personal, non-commercial use only, and you may not reproduce, distribute, modify, or publicly display any content without our prior written permission.

  • Trademarks, trade names, and logos displayed on the Services are owned or licensed by Buy Vibes or third parties. You must not use them without permission.

  • The Services may include access to third-party tools, integrations, or links. We do not control or endorse those tools and are not liable for their performance or privacy practices.

  • Using any third-party tool is at your own risk; you should review their terms and privacy policies independently.

  • We are not responsible for content or services on third-party websites to which we link. Your use of such sites is at your own risk.

9. Relationship with Shopify

  • Our Services are powered by Shopify, but any purchase you make is between you and Buy Vibes.

  • Shopify is not responsible for your purchase, product liability, or any disputes between you and us.

10. Feedback & User Content

  • If you submit feedback, reviews, suggestions, or any user content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, modify, publish, and distribute it for any purpose.

  • You represent that you have the rights to submit the Feedback and it does not infringe on any third-party rights.

  • We reserve the right (but are not obligated) to monitor, edit, or remove Feedback that violates these Terms.

11. Errors, Omissions & Modifications

  • Occasionally, our site may contain typographical errors or inaccuracies (in pricing, product descriptions, or availability). We reserve the right to correct them and cancel any orders affected by them.

  • In case of termination, you remain liable for obligations incurred up to the date of termination.

  • To the maximum extent permitted by law, Buy Vibes and its affiliates, partners, officers, directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, cost of procurement of substitute goods, or any damages arising from your use (or inability to use) the Services or products, even if we knew such damages were possible.

  • In jurisdictions (including in India) where limitations of liability are restricted, our liability will be limited to the maximum extent allowed under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Buy Vibes, Shopify, and their officers, directors, employees, agents, and affiliates from any claims, liabilities, losses, damages, and expenses (including legal fees) arising out of:

  • Your breach of these Terms

  • Your violation of laws or third-party rights

  • Your use of the Services, including any user content you upload

We may take control of such defense at your cost, and you agree to cooperate.

17. Severability & Waiver

  • If any clause of these Terms is found to be invalid or unenforceable under applicable law, that clause will be modified or severed to the minimum extent necessary, and the rest of the Terms remain in effect.

  • A waiver of any right or provision under these Terms will only be effective if in writing. A failure to enforce a right is not a waiver of that right.

18. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and any policies or operating rules we post, constitute the entire agreement between you and Buy Vibes regarding the Services. They supersede all prior or contemporaneous agreements or communications, whether written or oral.

19. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms without consent.

20. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India, particularly the laws of the state where Buy Vibes is headquartered.

  • Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in that region, unless otherwise required by applicable law.

  • Before initiating litigation, you agree to first attempt to resolve the dispute via good-faith negotiation or mediation.
